try latest stable kernel, r8169 got a few patches since 2.6.24

Or try to use the r1000 driver from Realtek (though the option above
makes more sense).

Like Kenny, I had no Oops (but others, eg dropped connection) troubles
with an RTL8101E in a Toshiba nb, with both r1000 and in-kernel r8169.
